Monitoring Board Disciplinary Orders

Health licensing board disciplinary orders and negotiated settlement agreements often include conditions with which the disciplined licensee is required to comply. Examples of such conditions include having a chaperone present when seeing female patients; successfully completing an ethics course; working under the direct supervision of a colleague, and so on. Some boards devote considerable resources to monitoring licensees to assure compliance with disciplinary orders. Other boards devote few, if any,resources to this essential activity.

The Oregon Board of Medical Examiners makes compliance monitoring a priority. At this CAC webinar, the executive director and the chief investigator of this licensing board described how the Oregon Board of Medical Examiners carries out compliance monitoring.

Kathleen Haley has served as Executive Director of the Oregon Board of Medical Examiners since 1994. She has been a past member of the Administrators in Medicine (AIM) Board of Directors serving as AIM Western Region Representative and a past member of the Federation of State Medical Boards (FSMB) Board of Directors. Ms. Haley has been active in helping her states healthcare-related agencies and institutions prepare for implementation of the federal HIPAA act, and state legislation dealing with pain management and physician reporting. Previously, Ms. Haley spent 10 years as Executive Director of the Oregon Psychiatric Review Board. She was in private practice briefly after moving to Oregon from her native New York state, where she served as an assistant Attorney General and assistant public defender. Ms. Haley has authored numerous legal briefs and articles, many of them also dealing with governmental and medical affairs. She is a graduate of the State University of New York, Cortland, and the New England School of Law, Boston.

Terry Lewis

Oregon Board of Medical Examiners

Terry Lewis has served as the Compliance Officer, Investigations Department for the Oregon Medical Board since 2006. In this capacity, he is responsible for all aspects of investigation of possible violations of the Oregon Medical Practice Act (ORS Chapter 677). He is also responsible for the monitoring of physicians who are subject to Medical Board disciplinary orders, to ensure compliance with the terms and obligations of the order.

From 1984 2006, Mr. Lewis was a sergeant with the Bakersfield Police Department. He has supervised patrol officers, traffic officers, gang investigators, detectives / investigators, and civilian staff. His last assignment with the Police Department was as a supervisor of a methamphetamine drug task force (Cal-MMET).

Mr. Lewis has been awarded the following professional certificates from the California Commission on Peace Officers Standards and Training (POST): Basic - 1986, Intermediate - 1990, Advanced - 1995, Supervisory - 1998. He is a graduate of the POST Supervisory Leadership Institute (2001).

From 1976 1982, Mr. Lewis was with the United States Army Military Police Corps, assigned as a Military Policeman and Drug Investigator in Frankfurt, Germany. His final years of service were as a CID Special Agent / Criminal Investigator.
